Terms of Use
Unless otherwise specified, the terms of use detailed in this section apply generally when using this Application.
Single or additional conditions of use or access may apply in specific scenarios and in such cases are additionally indicated within this document.
Unless where otherwise specified or clearly recognisable, all content available on this Application is owned or provided by the Owner or its licensors.
The Owner undertakes its utmost effort to ensure that the content provided on this Application infringes no applicable legal provisions or third-party rights. However, it may not always be possible to achieve such a result.
In such cases, without prejudice to any legal prerogatives of Users to enforce their rights, Users are kindly asked to preferably report related complaints using the contact details provided in this document.
Through this Application Users may have access to external resources provided by third parties. Users acknowledge and accept that the Owner has no control over such resources and is therefore not responsible for their content and availability.
Conditions applicable to any resources provided by third parties, including those applicable to any possible grant of rights in content, result from each such third parties’ terms and conditions or, in the absence of those, applicable statutory law.
This Application and the Service may only be used within the scope of what they are provided for, under these Terms and applicable law.
Users are solely responsible for making sure that their use of this Application and/or the Service violates no applicable law, regulations or third-party rights.
No Waiver
The Owner’s failure to assert any right or provision under these Terms shall not constitute a waiver of any such right or provision. No waiver shall be considered a further or continuing waiver of such term or any other term.
Service Interruption
To ensure the best possible service level, the Owner reserves the right to interrupt the Service for maintenance, system updates or any other changes, informing the Users appropriately.
Within the limits of law, the Owner may also decide to suspend or discontinue the Service altogether. If the Service is discontinued, the Owner will cooperate with Users to enable them to withdraw personal data or information and will respect Users' rights relating to continued product use and/or compensation, as provided for by applicable law.
Additionally, the Service might not be available due to reasons outside the Owner’s reasonable control, such as “force majeure” events (infrastructural breakdowns or blackouts etc.).
Service Reselling
Users may not reproduce, duplicate, copy, sell, resell or exploit any portion of this Application and of its Service without the Owner’s express prior written permission, granted either directly or through a legitimate reselling program.
Intellectual Property Rights
Without prejudice to any more specific provision of these Terms, any intellectual property rights, such as copyrights, trademark rights, patent rights and design rights related to this Application are the exclusive property of the Owner or its licensors and are subject to the protection granted by applicable laws or international treaties relating to intellectual property.
All trademarks – nominal or figurative – and all other marks, trade names, service marks, word marks, illustrations, images, or logos appearing in connection with this Application are, and remain, the exclusive property of the Owner or its licensors and are subject to the protection granted by applicable laws or international treaties related to intellectual property.
The Owner reserves the right to amend or otherwise modify these Terms at any time. In such cases, the Owner will appropriately inform the User of these changes.
Such changes will only affect the relationship with the User from the date communicated to Users onwards.
The continued use of the Service will signify the User’s acceptance of the revised Terms. If Users do not wish to be bound by the changes, they must stop using the Service and may terminate the Agreement.
The applicable previous version will govern the relationship prior to the User's acceptance. The User can obtain any previous version from the Owner.
The Owner reserves the right to transfer, assign, dispose of by novation, or subcontract any or all rights or obligations under these Terms, taking the User’s legitimate interests into account. Provisions regarding changes of these Terms will apply accordingly.
Users may not assign or transfer their rights or obligations under these Terms in any way, without the written permission of the Owner.
We reserve the right to refuse your offer should it be necessary.
For Online Ordering, you are obliged to pay the restaurant the fee which it charges for the food (and any other products and/or services) you order, together with the restaurant’s delivery charges.
Food UK Food accepts the following forms of payment for online ordering:
In the event of Food UK Food needing to issue a refund we will endeavour to credit your account within 21 working days.
The owner of the card used to make payment must present this card on receiving the order.
We act as commercial agents for the restaurants that appear on Food UK Food. Accordingly, if you pay Food UK Food the relevant amount using any payment method set out above, you will be deemed to have paid for your Order and you need not be concerned with whether the money paid via Food UK Food is passed onto the restaurant you have ordered from.
Card payments are secure.
Food UK Food does not accept cheques, Diners Club or other means of payment other than those detailed above.
Although every care is taken, some products may contain nuts.
When submitting your order details you may wish to offer to purchase the items specified in conjunction with a particular offer or promotion. To take advantage of this facility you will need to enter the appropriate promo code with your order details. These codes are presented on our menu and other items of promotional literature from time to time.
Any such order will be subject to the specific terms and conditions of the promotion in question and will be subject to availability. We reserve the right to refuse or withdraw any Food UK Food promotion or discount at any time.
Our aim is to meet a delivery window for our customers, agreed at the time of placing the order. Whilst we will do our utmost to meet this delivery time unfortunately there may be factors beyond our control that prevent us from meeting the time slot.
We shall have no liability whatsoever for any delay or failure to deliver to you where such delay or failure is caused by a circumstance beyond our reasonable control. Such circumstances include, but are not limited to:
Your Order Confirmation is a record of our agreement to deliver the products ordered and paid for in full. If someone else made the booking on your behalf, you agree that such person acted as your agent.
Amendments to the order or delivery time can be made no later than 1 hour prior to the start of the delivery window booked. Amendments to the content of your order can be made up to 1 hour before the delivery window begins.
Amendments to the order must be made by phoning the store you have placed the order at and quoting your order number. Your initial payment will be cancelled and a new payment raised.
The delivery time slot may be altered up to 1 hour before the start of your order window. The order can only be changed to a new time slot if it is available.
Orders may be cancelled in full up to 1 hour before the start of the delivery window selected. We will endeavour to issue a refund to your credit card account within 21 working days.
Cancellations within 1 hour of the start of the delivery window will be charged in full.
When making a booking over the Internet you must carefully check the details in the "Place Order" screen of the Food UK Food website. Once you have pressed the "Place Order" button an Order Confirmation with confirmation number will be displayed.
It is the customer’s responsibility to enter the delivery address in full to ensure the driver may locate the correct property for delivery. Failure to deliver due to incorrect address details will be charged in full.
You must ensure that delivery can be made to the address during the selected window. If we are unable to make delivery at the given address in the selected time slot then we will deem the order cancelled at full cost.
No rescheduling of time will be permitted.
In the case of addresses that are irregular or difficult to locate, it is the responsibility of the customer to clearly mark special delivery instructions in the box required. Failure to do so may result in a delayed delivery, or the order being cancelled by Food UK Food.
If you have specific allergies or intolerances, it is your responsibility to directly contact the Business to ensure the suitability of the Product before placing your order.
All communications relating to the use of this Application must be sent using the contact information stated in this document.
Should any provision of these Terms be deemed or become invalid or unenforceable under applicable law, the invalidity or unenforceability of such provision shall not affect the validity of the remaining provisions, which shall remain in full force and effect.
